Staff Agreement
A. General WarCry Corp. policy and the Fair Labor Standards Act (FLSA) permit independent contractors to provide services without being subject to the strictures of wage, hour, and other labor laws. Independent contractors, as that term is used in this policy, are persons who provide services to WarCry but who are not subject to the same strictures of control or supervision as employees of WarCry. Performance of work for WarCry as an independent contractor is in exchange for good and valuable consideration, the receipt and sufficiency of which is acknowledged by continued performance of work for WarCry as an independent contractor. The copyright to any copyrightable material created by any independent contractor(s) as part of his services rendered to WarCry will be retained by the independent contractor(s), but WarCry will receive a non-exclusive, non-transferable, irrevocable license to copy, publish, distribute, and otherwise use the material for its business. Because the license is non-transferable, WarCry will not sell or sub-license the material (except to an affiliate or subsidiary of WarCry) without the express written consent of the independent contractor(s) who created it. If and when the relationship between an independent contractor and WarCry is terminated, WarCry shall retain its non-exclusive, irrevocable license to any and all material created as part of his services rendered to WarCry. This license shall remain non-transferable for a period of six (6) months following the termination of the independent contractor relationship, after which WarCry shall be able to freely transfer, sell, and sub-license the material. Independent contractors are not mandated by specific work hours or schedules, aside from those schedules that they take upon themselves. Subsite managers oversee their production only to ensure quality and compliance with WarCry policies outlined in Subsection D: Subsite Policies. The Independent Contractor Procedures and Form shall be used for each independent contractor appointment. Since independent contractors are not considered employees of WarCry for Worker's Compensation purposes, they are not required to sign the standard hiring or employment forms; they are required to fill in an application for administration and tracking purposes. The usual departmental approvals required for the hiring of staff employees are necessary, subject to final approval by the Community Development Manager. Those benefits which are based on pay status do not apply to independent contractors. Therefore, staff volunteers are not eligible for sick leave, holidays, vacation, retirement or insurance benefits other than those available under Worker's Compensation laws. B. Age Requirements Each independent contractor must adhere to minimum age requirements. Minors under age eighteen (18) who have neither graduated from high school nor the equivalent, nor have been awarded a certificate of proficiency, may be employed with a permit issued in accordance with State law. Minors must provide certification of their age to support the staff volunteer employment authorization process and must adhere to the following: 1. Minors between the ages of sixteen (16) and eighteen (18) must provide a Work Permit from their school. 2. Minors under sixteen (16) years of age must provide Written Authorization from their parents. C. Independent Contractor Appointments Independent contractor appointments are approved for the duration of the subsite's existence as long as they remain in compliance with the needs of the individual subsite and its manager and do not abuse any other WarCry policies. No independent contractor is obligated to stay with the network and/or specific subsite if their interest wanes. However, they will make every effort to communicate their departure in a timely fashion. D. SubSite Policies A. Sharing HitCount Information with Developers The WarCry Network agrees to provide hitcount information (for the relevant subsite) to the developer/publisher as long as they (the developer/publisher) understand and agree to keep such information confidential. This includes, but is not limited to non-disclosure with other website operators and/or developers/publishers. B. IRC The WarCry Network has a No-bot policy on the channels. If there are extrenuating circumstances, they may be brought up to management. C. News Cross-Posting The WarCry Network promotes and encourages cross-posting when relevant. However, subsite managers have autonomy to decide what cross site news they are willing to post when it regards cross site promotion. Network-initiated news should be distributed to all subsites in a timely manner; this includes, but is not limited to, general gaming news (such as interviews and contests) or network status information. For example, it is not company policy to force the Asheron’s Call subsite to publish game-related news for EverQuest. D. General Conduct for all Network members 1. The news page is not a forum for debate. 2. Unverified news should only be posted with extreme caution and should include a statement stating that it is unverified. 3. Content on the news page should be unbiased and unoffensive. 4. When dealing with the public, independent contractors will act in a professional manner. 5. Do not engage in flame wars in a public forum. Healthy debates are acceptable as long as participated in a professional manner.
